Privacy Notice

How we collect, use, and protect your personal data when you interact with Barbottina Ceramics online or offline.

1. Controller identity

CEDEREY, S.A.P.I. de C.V., operating under the trade name BARBOTTINA CERAMICS (hereinafter, “Barbottina”, “we”, or “the Company”), is the data controller responsible for the processing of your personal data in accordance with Mexico’s Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations.

2. Scope

This Privacy Notice applies to personal data collected through our website, online store, contact forms, newsletter sign-ups, WhatsApp or similar messaging channels, point-of-sale / showroom interactions, quotes, orders, payments, shipping, and customer support related to sales in Mexico and export markets (including the United States), unless a separate written agreement provides otherwise.

3. Personal data we collect

Depending on how you interact with us, we may collect:

Identification & contact

  • Full name, company name, job title
  • Email address, phone / WhatsApp number, shipping and billing addresses
  • Tax information required for invoicing (e.g., RFC, tax regime, CFDI usage) when applicable

Commercial & transactional

  • Order details, product preferences, quotes, delivery instructions
  • Payment status and transaction references (we do not store full card numbers on our servers when payments are processed by Openpay or POS providers)

Technical & browsing

  • IP address, browser type, device information, pages visited, referral URLs
  • Cookie identifiers and similar technologies (see section 8)

Communications

  • Messages sent via contact forms, email, WhatsApp, social media, or customer service
  • Newsletter preferences and engagement metrics (opens/clicks) when you subscribe

We do not intentionally collect sensitive personal data. If you voluntarily provide it, it will be treated with heightened care and only for the purpose you indicated.

4. Purposes of processing

Primary purposes (necessary to provide our products and services)

  • Respond to inquiries and provide quotes
  • Process, confirm, manufacture, ship, and invoice orders
  • Manage payments, refunds/replacements where applicable, and customer support
  • Comply with tax, accounting, and consumer-protection obligations
  • Operate and secure our website and e-commerce platform

Secondary purposes (optional; you may refuse without affecting the purchase)

  • Send newsletters, promotions, product launches, and design inspiration
  • Invite you to events, surveys, or brand communications
  • Analyze site usage to improve content and user experience (analytics cookies, if accepted)

If you do not wish your data to be processed for secondary purposes, you may opt out at any time as described in section 11.

5. E-commerce & Openpay

For online purchases, Barbottina may use Openpay, PayPal, and/or other payment gateways as payment processor. Card data is typically entered and processed on the payment provider’s secure environment under their own privacy and security policies. Barbottina receives confirmation of payment, limited transaction identifiers, and information needed to fulfill your order.

In-store purchases may be processed via point-of-sale (POS) terminals with credit or debit cards, or in cash. Please also review our Terms and Conditions and payment information pages.

6. Newsletter & marketing

If you subscribe to our newsletter or accept marketing communications, we will use your email (and, where provided, your name) to send brand updates, product news, and promotions. You can unsubscribe via the link in each email or by contacting us at hi@barbottina.com. Unsubscribing from marketing does not affect transactional emails related to your orders.

7. WhatsApp & messaging

When you contact us through WhatsApp or similar messaging apps, Meta Platforms / WhatsApp (or the relevant provider) processes the communication under their terms. Barbottina uses the conversation content and your phone number to assist you with products, quotes, orders, and support. Please avoid sending unnecessary sensitive information through messaging channels.

8. Cookies & similar technologies

Our website uses cookies and similar technologies to:

  • Essential / strictly necessary: site operation, security, cart/session, remember cookie preferences
  • Functional: improve usability and remember preferences
  • Analytics / performance: understand how visitors use the site (only if you accept them)
  • Marketing: measure campaigns or personalize content where enabled (only if you accept them)

On your first visit (or after consent expires), we display a cookie banner so you can accept all cookies or continue with essential cookies only. Your choice is stored in a cookie (for example, barbottina_cookie_consent) so we know whether to show the banner again.

You may also control cookies through your browser settings. Blocking essential cookies may affect checkout, login, or other site features.

9. Transfers & processors

We may share personal data with third parties only as needed to fulfill the purposes above, including:

  • Payment processors (e.g., Openpay, PayPal, POS providers)
  • Shipping carriers and logistics partners
  • Hosting, email, CRM, analytics, or IT service providers acting as processors under our instructions
  • Professional advisors and authorities when required by law

Domestic or international transfers will be carried out in accordance with applicable Mexican privacy law. We do not sell your personal data.

10. Retention

We retain personal data only for as long as necessary to fulfill the purposes described, including legal, tax, and warranty-related retention periods, and then delete or anonymize it securely when no longer required.

11. ARCO rights & consent withdrawal

You may exercise your rights of Access, Rectification, Cancellation, and Opposition (ARCO), as well as limit use or disclosure and revoke consent for secondary purposes, by sending a request to hi@barbottina.com including:

  • Full name and means to contact you
  • Clear description of the right you wish to exercise
  • Documents proving your identity (and, if applicable, legal representation)

We will respond within the timeframes provided by applicable law. You may also file a complaint with Mexico’s privacy authority (INAI) if you believe your rights have been violated.

12. Security measures

Barbottina implements administrative, technical, and physical measures designed to protect personal data against damage, loss, alteration, destruction, or unauthorized use or access. No method of transmission or storage is 100% secure; we continuously work to improve our safeguards.

13. Minors

Our products and website are directed to adults. We do not knowingly collect personal data from minors. If you believe a minor has provided us data, please contact us so we can take appropriate action.

14. Changes to this notice

We may update this Privacy Notice to reflect legal, operational, or service changes. The updated version will be published on this page (https://barbottina.com/privacy-notice) with the last-updated date. Continued use of our services after publication constitutes awareness of the updated notice, without prejudice to rights that require fresh consent.
